As a result, the Court has directed the National Management Authority to develop policy or guidelines for identifying cases of death caused by the after effects of Covid-19 vaccination and reimbursing the victims’ dependents.

The National Disaster Management Authority was ordered by the Kerala High Court on Thursday to develop policies or guidelines for identifying incidents of mortality brought on by the side effects of the Covid-19 immunization and for paying the deceased’ dependents within three months, reports Live Law.

Justice V. G. Arun noted that there have been cases where people are suspected of dying as a result of immunization side effects; in these kind of cases, the National Disaster Management Authority and the Ministry of Health and Family Welfare are obligated to develop a policy for identifying such cases and reimbursing the victim’s dependents.

I have come across at least three cases where pleadings are to the effect that the person who has undergone Covid-19 immunization vaccination had succumbed to the after-effects of vaccination. Therefore, even if the numbers are very few, there are instances where persons are suspected to have succumbed to the after-effects of immunization. In such circumstances, respondents 2 and 8 are bound to formulate a policy for identifying such cases and compensate the dependents of the victim.

The Petitioner had addressed the Court demanding compensation for the families of deceased Covid-19 victims, as the petitioner’s husband died as a result of adverse reactions after immunization. After reviewing the materials, the Court concluded that there is prima facie evidence that the petitioner’s husband died as a result of the aftereffects of the Covid-19 immunization.

The Court previously asked Assistant Solicitor General of India, Advocate Manu S, to obtain information on whether the Government of India has developed a strategy for compensating victims of adverse incidents related to Covid-19 immunization.

When the case was up for hearing, the ASG told the Court that the Central Government had not yet devised such a policy.

As a result, the Court has directed the National Management Authority to develop policy or guidelines for identifying cases of death caused by the aftereffects of Covid-19 vaccination and reimbursing the victims’ dependents. Taking into account the immediacy of the matter, as the victims’ family members face extreme difficulties, the Court has directed that the necessary be done inside of three months.
